I still think this "punished twice for the same offence" principle is terrible. What sort of system lets employers fine someone AGAIN after they've been dealt with by the criminal justice system? The penalty at court should be the end of the matter.

I don't see it like that. I think the penalties for drink driving, while adequate for your garden variety punter, don't even go near making the point to a footballer that what they have done is not merely broken the law, they have set an appalling example to the thousands of kids who see them as a role model.

I suppose you could think of it as two offences:
1. Drink driving - punishable by the state.
2. Gross dereliction of the duty to set a good example that is part of being a footballer, whether you like it or not - punishable by the AFL/club.

Because sometimes, the law doesn't do its job.

I don't buy this "but kids see them as a role model" as sufficient justification for screwing around with the criminal law. Kids see pop stars and actors as role models, and they don't get fined twice.

(The other issue here is that according to their contracts, the maximum for a first offence is supposed to be $5000. So Collingwood has gone way over that.)

I think this is more an "employer interfering in people's personal lives" issue than a "setting a good example" one.

Setting aside the $5000 issue, which I didn't know about, and the Players' Association probably has a solid point on...

I think the role model thing is massive. Kids take their leads from their heroes (as an example, see how many junior footballers are getting about in white/red/blue boots these days). Seeing a guy they look up to get away with things like drink driving reeks of "do as I say, not as I do", and kids see through that in a second.

The only reason pop stars and actors don't get fined twice is because the mechanism isn't there to allow it (like the contracts the footballers sign). But I'd say that if a similar thing happened with, say, a "Neighbours" actor, there would be repercussions beyond the legal stuff.

I know you put a lot of faith in the law, Lefty. Given that you've taken an oath to uphold it, that's a tremendous thing. But I think this is a clear case of the criminal law being woefully inadequate for actually redressing the wrong that's been perpetrated: a $300 fine to someone on $200K a year might as well not exist.

Admittedly, it's a pretty narrow group of people that I think should be subject to this sort of regulation. But I can't see the harm in subjecting those with a responsibility to the community to a higher standard of behaviour. That's the nature of their job and they are paid handsomely for it.

Given that no Bulldogs players actually got charged can you really say that? Where are the big ALLEGEDLY and SUPPOSEDLY's?

I reckon I can probably swing it. They are famous for it, whether they were found guilty or not.

I'm thinking they aren't fined by the club for neglecting their responsibility to be good role models, but that they endanger vital sponsorship deals. Not just with the TAC, but with other companies who may decide that drink-driving rapists (this is just a general argument, not an accusation about any individual player) are not people they want to associate with.

Most of us, if we commit a crime outside of work hours, are not threatening our employer's viability, so our employer has no business butting in.

Also, it's for their own good (collectively) because footballers need to learn that they are not invincable, or gods - despite everything they've been told by their families, their school, their friends, their club, the telly, and their manager.
